If the truck driver had something in his system, then he can’t sue the department for the police chase ending with him in the hospital.
I think the opposite. Some sort of policy wasn’t followed in the pursuit, resulting in a catastrophic accident, and he wanted to show the victim was somehow at fault. Any alcohol or drugs in the system of a police victim, automatically exonerates the officer.
