i strongly agree with what you're saying but what's different is that kickstarter skirts investment rules and the designers of these ideas routinely fail to honestly, accurately, or properly list the risk factors associated with the "investment." most people simply don't realize that they're essentially speculating.

This is the reality for new products and business startups. A majority of them fail for a variety of reasons. Investors have been having to make risky bets for years before Kickstarter or Indiegogo were around to support these efforts. You should know it's a risk when you sign up.
