Consent in most states of the US is defined by Model Penal Code’s “Global Consent” doctrine. It goes like this.....
That would be the smart thing to do... but there seemed to be an elaborate hoax conducted that fooled the victim. Being naive is not a crime. Tricking someone into sex is.
The punishment for this crime should not be a 20 year stretch. But the answer to your question is yes. A transgender person should put the decision in your hands as to what you wish to do with your body. No one has the right to trick you into sex.
Consent induced by deception is not consent at all. Those terms exist in Model Penal Code which has been adopted in just about every state in the US.
Rape by Deception is a crime!
