It's not something that needs to be regulated. You don't need a cell phone, and you can choose a prepaid plan and bring your own device as someone else mentioned.
I'm on Long Island, NY, which is a very densely populated area compared to the rest of the country's suburbs, and I so far have been able to just walk in and buy the iPad3 and iPhone 4S on launch day. I assume demand for the 5 will be very high, though.
Wouldn't the damage to their BMW exceed the value of the Apple products they were stealing? They'd probably be remotely bricked the second they touch an Internet connection, too.
My next upgrade will certainly be the iPhone 5. I have a 4S. I considered considering whether it was a worthwhile upgrade or not, but I realized that while I may be able to hold off through the preorder, at some point I'll want it, so I might as well just give in and buy it now. Spoken like a true addict.

The problem is likely that Apple sells at least one generation behind at a discount, for a while. Currently, two generations. In three generations, how would the carriers market that? And if it weren't for said uber-popular gadgets, those factory workers would likely not have jobs. While I don't know any personally, I'd guess they'd choose the mundane factory work to living on the street and begging for food any day.
