The PS3 and Xbox 360 have been broken so that you can modify files of games. It's very much "hacking" and is very much ban worthy.
Right now, it looks like modders haven't figured out how to do anything particularly game-breaking yet.
They are equal to EA in terms of their untrustworthiness. Personally don't have too many issues with Activision though. If only because they have yet to make me $40 for what a previous generation of their game had as part of the package.
