I think the solution there is to make VR specific consoles. As it stands now, a user would need a high end PC ($1000+), and headset ($400+) in order to run Alyx. That’s a pretty big investment for one game.
What about games that have a neutral MC (Fallout, Skyrim, Pokemon, etc)?
Could always use one of those prepaid Visa cards. Once it runs out, there's nothing tying it back to you.
Think of it this way. Now Nintendo EPD has more resources that can go towards BOTW 2.
Keep in mind that on every other open platform (PC), Epic has chosen to release Fortnite through their own storefront. No one is coming that Fortnite isn't on Steam.

This is a pretty big deal. As you said, if someone wanted to make an accurate football game, player likeness, arguably, could be used.
If you go to another island to take advantage of foreign fruit prices, or stalk prices, leave a tip at the very least. Drop a stack of fruit or two for them to use.
It all depends on if this was known by the developer and Nintendo during the certification process. If the devs knew about this workaround, and didn’t tell Nintendo, then there’s a chance that the game will be delisted.
Something you didn’t mention is Turnips.
At one point, I contemplated that New Horizons was a prequel to the Gamecube game. When I saw that the Shop was named Nook’s Cranny instead of Nookling Junction, I imagined that Tommy would grow up to be the Tom Nook of that game. Meanwhile, the Human population would dwindle until only a few would be left.
If you go into your inventory and select a stack, there’s an option to Grab 1. That’ll take one from the stack, and place it in a new slot.
Flimsy tools aren’t hard to make though. Plus you get Nook Miles for crafting and breaking them.
After you progress to a certain point in the game, Tom Nook will host a workshop about it in the resident service tent. Essentially, you go to a workbench, select the customize option, and select what design you want. To make changes, you need customization kits, which can be bought at the shop from that day forward.
Running will scare fish in the water, and give you less time to notice bugs before they flee. You can easily miss out on some rare and expensive bugs if you're running everywhere.
