It appears so. What this decision really boiled down to is that while the NDPD operate with the full force & authority of a normal police agency, they do so at the whim of ND administration, and are therefore not subject to public records requests.

As I said, this is NOT a FOIA case. FOIA applies to only documents held by the US govt and its agencies. This is a matter of public records law in the state of Indiana.

So, until we know the specs of this, it’s premature to call it either way (although I, too, would lean SUV as this is a 7-seater).
