I think you would be able to challenge it and win if you put a stack on your truck for that purpose. Because just putting a stack on it doesn't help it emit smoke. You could use big rigs as an example. They have stacks so that the exhaust clears their trailers and doesn't exit at car window-height.

Actually it won't do that. The law is worded so that it only prohibits modifying the truck to smoke. You can still put an exhaust on your diesel and modify it to make stupid power. You just can't modify it for the soul purpose of generally being a douche bag and spewing fuel rich smoke.
