Except that they are exclusive retailers so they control the supply, which they are then using to artificially inflate the demand. I'm not a lawyer, so I can't comment on the legality of their practice, but it is certainly morally reprehensible.

The problem is they couldn't sell new for this price. Nintendo has an MSRP and would likely not be happy about that. I'm not sure if it is even allowed since they are exclusive retailers, Nintendo might have a limit on how high a new copy could retail for to avoid price gouging.

I checked and 10 different Gamestops within 20 miles of me each received between 1 and 3 copies last week. I talked to the one guy and he said they got two copies that seem to be in perfect condition and look brand new except they aren't shrink wrapped.

Yes I own one. I bought it because I have owned every Nintendo console ever made and they have never once disappointed me. And I don't regret it one bit.

I'm a collector, I like having physical copies so I rarely buy digital. In fact, just last week I fired up my SNES for a game of DKC with my woman.

And they are "branches" of Kotaku. All I'm saying is that you could have been nice about it, instead of sarcastic. There is no need.

You could ask nicely and they might edit it in the post. But honestly its an American website, run by American writers and an American parent company. Even given all that, they are still pretty good about mentioning Japanese and European news when they have it.
