How else would he have purchased a key? There aren’t any authorized resellers of Blizzard’s games. He had to log into Battle.net in order to purchase the game four times, so, it’s unlikely that the banned player didn’t agree to both Battle.net’s and Overwatch’s EULAs/TOS.
He didn’t mention trying to obtain a refund in the post from the linked PC Gamer article, you did. Who knows if he’s even made the attempt to recoup some of his money. Blizzard isn’t stealing. He is trying to bypass the ban and should probably pursue any refund that he feels entitled to receive.
You agree to the Blizzard EULA/ToS when you set up a free Battle.net account. That’s certainly before you play any of their games.

It’s a Titan 6GB (700 series) not a Titan X 12GB (900 series). Your 970 is supposed to outperform this card in games. Just like a 980 Ti is designed to out perform both the 970 and the previous gen Titan.
