And so do harps. Impeccable logic.
And so do harps. Impeccable logic.
Because nothing says “third-world material aspirations” like being photographed with consumer goods that basically expire within a decade model year.
Wouldn’t it be easier to just kick back and live off of a trust fund like DeMuro?
“...the stock tunes on most medium duty or industrial diesels made before the mid 90s were dirty...”
The Ron Sparingly Standard.
I think that is a great point, and it illustrates the defect in drafting the original agreement. When terms are not comprehensive or otherwise ambiguous, we must begin to discern the intent of the parties. That tour of the cranium is prone to error, estimation, bullshit, and higher transaction cost.
Nice. And no need to convert your plain language to “lawyerese.” Some of the most respected practitioners, law professors, judges, and sophisticated clients support drafting legal documents in plain language. Legalese serves no one well- except maybe interests who rely upon the other party not understanding the…
Because your “thinking abilities” have led you to conclude that EVs and hybrids actually clean up the environment (like magic!) and therefore to “play a bit” would still result in a marginal net benefit. It would not.
Oh, I dunno, is it because you are a homophobe? I mean, unless you are intimately involved with someone, why would their sexual orientation be any of your business?
Michaél,
I do not believe VW counsel described stripping as a “breach” of the agreement. To the contrary, VW counsel sounded as if he were appealing to the judge on a non-legal basis to address an issue that those responsible had clearly overlooked- stripping parts off of cars we presume to be destined for the crusher. Eg.,…
Oh B.S. It would have been easy to draft a clause to prohibit stripping.
True indeed. I understand your theory- but I’m sure your understand that the application of the UCC is often not so clear cut. Consider: An agreement to instal a new residential heating system. The contractor will supply the furnace and install, but generally, such an agreement is not considered a K for sale of goods-…
Is this a sale of goods?
Unless of course, it is not a breach of K.
Does the UCC apply to the terms of a settlement?
Winner.
Sensors or not, a human appears to be driving that tractor in front of those cut-rate flatbeds. Two trucks instead of standard car hauler? This smacks of a press statement intended to communicate the loss of a resource to CA state agency administrators.
“...that was most likely intentionally left vague as a goodwill gesture.”
Why do people get so worked up over this? VW negotiated the terms of the buyback. A (no doubt well-compensated) attorney drafted those terms. If someone wishes to hold VW to the terms of their buyback, what do we care?
