The price is in the right ball park for a diesel X5 of similar vintage, mileage, and visual condition based on a quick search. Go buy one of those instead of dealing with one that has a lien.

It’s a hybrid. You can’t just take the EV part on its own and say it’s no good. It’s how everything works together that makes the 330e a good car. 

It makes more torque and makes it from a dead stop. Which is what will matter on your 10 mile commute.
