I’m inclined to agree. I hate the sentence he imposed, but it was within the sentencing guidelines for a first-time offender. We all opposed mandatory sentencing requirements because it failed to allow judges to take into account the individual circumstances of each case, but we can’t have it completely both ways…

Okay, so this is going to be a very unpopular opinion, but although I think that Judge Persky’s sentencing was repulsive and any chief judge worth their salt should assign him only to commercial contracts cases or something similar in the future, I’m not sure that he should have been convicted of judicial misconduct.…
