Right now they can do what you’re saying, just fend for their members.
The law though allows non-union members to gain all the benefits the unions lobby and fight for without having to pay the union that fought for those benefits.

No. They can decide to not pay the dues. But they legally still have any benefits the union gets in bargaining. Hence the strong incentive to not pay dues because you get the same thing either way.
