I think your second paragraph is incredibly important to why colleges have separate hears through their conduct systems about sexual assault/rape. A majority of campus rapes are incredibly hard to prove in court, because they involve acquaintances and alcohol. It usually boils down to, as you said, a he said/she said.

Actually, all students have property rights when it comes to their college enrollments. All progress made towards a degree is considered property (since you pay a fuckload of money for it), and thus all students, after matriculation, are considered to have a liberty interest while enrolled at the university.
