I think I would argue that the scenario you describe would count as premeditation. The problem would be proving it. Your best hope would be other cops testifying that he said things to such effect (similar to what FlamingFeminista posted above), though how likely is that to happen?

It is a win, and a good thing, despite the circumstances. But it was one that shouldn’t have been made so hard to fight for. I have great respect for the family, friends and community of Laquan for putting up that fight. And sympathy, of course, sadly. At this point however, I can only hope this one positive outcome…
