You’re right, there are a lot of instances and yes, there are a ton of botched cases for whatever the reason may be. But in this case, there isn’t enough evidence to bring it to a grand jury.

If they are attacked, injuries are usually visible. If they are robbed/mugged, things are missing. If it’s a murder, someone is dead. The difference is immediate proof.
