How can the government force anyone to do work for them that goes against their own business?
How can the government force anyone to do work for them that goes against their own business?
The 5th Amendment has much more to it than protection from self-incrimination. The part Apple is using in this case would be “nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.”
There has to be a reasonable solution to this.
The Fifth does apply. Not in the self-incrimination sense but in terms of due process. Essentially it is unconstitutional for the government to permanently break a corporation’s trade secret over 17 minutes in a criminal investigation timeline (or any number of minutes). And the FBI might already have data or other…
So all they’d have to do is insert another device’s UID to make the software work for a different iPhone. That’s a trivial change, and thus the software they’re requesting might as well be a universal backdoor.
Fandroid spotted. Don’t distort the facts this time - Apple happens to be also protecting your own precious privacy wether you like it or not. Thank them later.
They’re asking them to put a backdoor in for a single device that is tied to that device’s UID. You could not take this same OS they create and put it on another phone.
You’re misconstruing which portion of the Fifth Amendment Apple is invoking - it encompasses MUCH more than just a protection against self-incrimination:
“No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the…
so Apple is saying that if it helps the FBI safely unlock this phone, it will implicate itself in a crime?!?? do tell! so Apple is already guilty of something. what could it be??
I say screw the government. I am no terrorist. I have nothing to hide. I have dignity. I value my privacy. I have all my shit encrypted. My phone has a pin lock like all you other weak morons that think the government can be trusted not to abuse it. Pin is in my head. There it shall stay. What’s next? Feds gonna file…
It won’t matter in this case. Thousands of people raging with picket signs in front of courthouses nationwide might matter, but furious 20-somethings raging online from the comfort of their computer chairs or while on public transpo with their phones isn’t going to sway this court on terrorism, not with the DOJ and…
But it does have everything to do with the public.
I think that the Fifth amendment probably refers to the currently deceased terrorists, with the FBI insisting that Apple help those two self-incriminate themselves.
If you don’t think public opinion means anything to judges, you haven’t been paying attention to any major court case in recent years. Judges may not admit that public opinion matters (only the law!!!), but a non-response is not the same as a negative. Public opinion certainly mattered in the same-sex marriage cases.
This is simple logic people! On the contrary, it shows an egalitarian view that believes all people should matter and should be treated equally regardless of race. It is far better to focus on treating all people equally in life than to continue labeling others by their skin type and treating them differently based…
For someone who is apparently so smart, Zuckerberg is an idiot for calling people who disagree with the BLM movement racists.
Not sure I’d say that it is effective, the BLM movement is really their own worst enemy.
If that’s the case, then why have a problem saying “All Lives Matter” instead?
Why are you guilty of something in America just for being born a white, Anglo-Saxon male?
