This is why it's not wise to make use of university sponsored mental health services. FERPA's main gist is pretty ok, but the loopholes need to closed or it will continue to be used to violate the very freedoms it was created to protect.

To the best of my knowledge (I work in higher ed and have been through hours and hours of FERPA and TIX training), it doesn't matter whether she's suing for malpractice or for civil rights. As long as she's suing, it still falls under the exemption.
