I think adding that in America, HR acts independently when making the final decision in hiring/firing employees. His supervisor would have had to IMEDIATELY report it to the HR department. The supervisor can give his/her opinion but ultimately HR makes the decision, and many times NDAs include ‘no exception’ clauses.
