My response was to OP, who was conflating being not-at-fault with safe driving. I was pointing out that these concepts were not mutually exclusive.

Literally everyone here is saying what the motorcyclist did was the opposite of safe. You’re just the only one saying that the lane-change was not the primary cause of this accident.

...but if I look and see room to make a lane change in front of another vehicle, I’m going to change lanes. I’m not going to assume that the biker driving between cars is too stupid to slow down and avoid running into me.
