You'd have trouble convincing almost anyone that they were at much more risk than anyone else that was driving on a normal road

If something does not normally happen given a set of circumstances, it is not unreasonable to assume that it will continue to not happen unless there is another factor or something about the situation is different. If something is the rule, you don't go around assuming every situation

With modern safety equipment and airbags, a 40 mph, total, collision may kill someone but it is unlikely that both or all parties to an accident would die if they were wearing seatbelts. We also don't know if this was a complete and direct head on collision, or an offset head on collision.
