For me, it served to cement this show's Fisk as a villain, as opposed to just an asshole developer with ties to the criminal underworld. The shot looking up at D'Onofrio, with that characteristic Kingpin look on his face as he choked Ben to death, was the most convincing and iconic display of his evil for the whole

The most obvious point in favor of his not having powers: He is locked out of the back door of the theatre. No one else is around and if he had powers and was hiding them, he could have broken the doors open without being found out. But he has to walk around and enter through the lobby like a mortal human.
