Good job breaking it down, but in duty of care, I believe it’s rather more specific: Does this particular Defendant owe that particular Plaintiff a duty of care? Sometimes, the answer is no, and inquiry stops right there; case dismissed. “We all owe each other a duty of care” is not the inquiry, in my humble opinion.
