At least in my state, which copied California’s three-strikes law, the three felonies have to be separately committed and charged, and not part of the same action. So he would need two prior convictions for this set of three convictions to trigger the sentencing enhancement.

As EmForster said, he wasn’t charged with rape because the assault he committed on her isn’t rape under California law, but is called penetration with a foreign object (i.e., his fingers). The three strikes law applies to all violent felonies. Did you read something that said he conviction wouldn’t fall under that?

The DA couldn’t charge Turner with rape, because CA’s rape statute requires “sexual intercourse.” Neither fingering nor dry humping are “sexual intercourse” under the law.
