I think they could make a solid case here that Apple is, like Microsoft before it, using its dominant role as a hardware vendor to give itself an unfair advantage in the software market (after all, they and anyone they make a deal with gets to avoid that 30% revenue hit!). Installing an update to the game itself should barely touch save data. If it does, it should be patching saves, and should only need to run a small script against those (relatively) tiny files, which could definitely be backed up…
