In the scenario you listed, there may be no criminal charges, but a civil lawsuit filed against the owner is absolutely a possibility (depending upon the circumstances).

My guess? This news depresses property values in the areas either end of the tunnel. TrumpOrg coincidentally picks up some key properties in those areas. Being from the city my friends and I would always hangout “outside” but never ventured too far into “White people territory”.
