Everyone hates lawyers until they need one. It used to be judgment by the lord of the manor or the King. I believe that ended with a King at the end of a sword agreeing that lawyers were better. 

Arbitration should be less expensive and quicker. Also, per Steve Lehto, it doesn’t always work well for the corporation with arbitrators sometimes looking at the claim and deciding the amount is not nearly enough. 

I’ve seen people walk into water fountains while looking at phone; at least in this case why would anyone expect a hole to be in a grassy area? Maybe the phone, maybe clouds, maybe looking at the trees. Perhaps the dog went around the hole and pulled him towards it.

That presumes this is a narrow forest trail. That is not where one would land a helicopter. This has to be an area that is well clear of all trees and therefore unexpected obstacles. There are some places with intersections a mile or more apart. A 100 foot traverse becomes a 5000 foot detour, a 50X increase. Imagine the reaction of drivers on a 10 mile trip being sent on a 500 mile detour.
