I think that depends on the state. I have an MD friend who signed a 15 pr 20 miles non compete in MO, assuming it was in enforceable. Then she found out from several colleagues that the hospital regularly sues anyone who tries to break it. Which is insane, because there are lots of medically under served areas in MO &

And the further question is it even binding when dealing with someone below the age of 18? Yeah it's a great intimidation tactic on a 16 year old kid but even a knowledgeable parent that is not a lawyer could probably get this tossed. Most states do not allow anyone under the age of 18 to enter into a binding contract

There's no way this would hold up in court, it doesn't pass the reasonableness test used in the common law. And several states (including California) ban the enforcement of noncompetes for anyone. So this basically is all bark and no bite.

You are sort of right about the legality, except it is very very difficult to enforce them in court. It is literally impossible to enforce them in California (they are banned by California Civil Code, and you can even sue an employer for making you sign one).

JJ won't try to enforce it. It's silly and won't be upheld. They are just hoping that it deters former employees from going to the competition.

This. This is why the NFL players can never have good things. They are the biggest group of pushovers in sports. They play the most popular sport by far, but constantly let the owners and the league put them over a barrel on everything.

These types of non-competes would never be upheld by a (competent) court - but that doesn't mean it wouldn't scare employees and stop them from getting new jobs. Just terrible.

Almost every time, they won't bother to bring suit. The risk is HUGE that you'll go to court and the judge will make them pay fees, your lawyer, and whatever else they can tack on. Judges do NOT like these clauses.

I'm shocked places still have these. For the most part, they're completely unenforceable outside of a very small set of circumstances. Any agreement that would make it difficult for someone to find new work is going to be thrown out.
