It’s not cheap, but the photographer has essentially a rock solid case. If they found in favor of MSI it would basically mean anyone could do anything with another’s copyrighted work, ex: slightly edit it and sell it for profit.
If MSI does win it would be the equivalent of the court saying “yes, you can take a copywritten work ex: a song and remix it and sell it for profit or advertise with it for profit, because it’s a transformative work.” can you even imagine how the music industry would react. lol.

The whole conversation basically boils down to an argument over the ethics of piracy. Wouldn’t you agree?
I’m not saying they don’t have legal recourse to shut them down. Blizzard have every right to shut them down it their copyrighted material. I would argue it may not be the right thing to do however.
Yeah, I saw someone beat me to it right after I posted it, but I wasn’t willing to go back and delete what I put. A problem with your return argument, none of those shows are over a decade old. (I think)
But the version of the game they want to play doesn’t exist anymore and isn’t active. Vanilla WoW and current WoW are night and day experiences. Very different in many, many ways.
Lets use your stealing cable analogy. It is kind of like stealing cable, but you are only stealing programming from over 10 years ago and its no longer available in that form today, so stealing is the only way to get said content (in that form). So you’re stealing cable, but only cable that showed on TV over ten years…
Some technology based on Microsoft’s Kinect and maybe a glove with sensors on the fingers for highlighting/clicking etc. Would probably work. Then the Kinect would finally have been useful lol.
