Thanks to MADD (and other similar organizations) the victims have successfully sued and won. That’s why the legislation exists, and mandates that bartenders cut people off.
Bartenders are NOT manufacturers, and thanks to MADD they are legally responsible for what your drunk ass does after leaving the bar.
In regards to alcohol, as a result of lawsuits, bartenders are responsible for what drunks do. Therefore, they can legally cut someone off without being accused of discrimination.
