Those inherent bias tests are interesting, but I also wonder if there is a different bias at play in the fact that everyone there is a criminal and that is what causes the reaction more so than the race of the person they are dealing with.

Legally intent in this case would only be the intent to make the physical contact - i.e. Poussey grabbing his arm. Her motivation for why she chooses to grab the arm is legally irrelevant, so long as she intentionally grabbed his arm.
