The ethical part has to do with the wrong choice of making the claim afterward considering the circumstances of what all took place. It's not referring to what happened 'during' the alleged psychotic break.

I suppose some of it depends on the "maturity-level" of the series and its tone in terms of what topics they want to explore and how in-depth they want to go. Is The Leftovers going to get a little more risqué and start to tackle these types of controversial issues?
The audience must sympathize with the characters so they care about what happens to them. If the audience is indifferent and doesn't care about the characters, why would they watch the show? That doesn't mean in every incident the characters are perfect and innocent. They're human and they make mistakes.
I'm referring to the nature of the subject matter, not the general idea of how ambiguity makes for interesting viewing. To be specific, the nature of taboos like rape, or child abuse, or underage sex, would be topics to be clear about what happened and show in no uncertain terms that the characters is innocent.
