I'm not necessarily cool with it, but otherwise the DEO becomes a prison for life for civilians without a trail. That takes us back to season 1 where James complains to Kara about Max Lord being held indefinitely.

Plot holes are a major issue in many of the episodes. I think the constant rotation of visiting writers rather than a set team may be the issue. Plus, as someone said earlier, CW needing to plan better.
