Yeah, I just looked up the NY penal code, and apparently you can be charged with disorderly conduct for cursing in public. Kind of seems like a 1st amendment violation, but they can arrest him for it if he did.

In New York, disorderly conduct requires that the person has the intent to cause a disruption. So ignorance actually would be a defense in this case.

I wouldn’t ride a bike without a helmet and open toe’d shoes. I also wouldn’t ride through a police barricade. But what I would do has nothing to do with this.
