Honestly, any good lawyer could argue he did nothing illegal. There is an abundance of precedent in common law that back up property owners when they are exerting their rights over land they have an easement or right-of-way on.

In my jurisdiction it would likely be two charges. One for wilful destruction of property for breaking the window, and another for mischief for putting the car into gear. If I’m not mistaken, this would translate in to one to two vandalism charges in most US states.

I’ll say it again for the kids in the back, there is no possible way a theft charge would be laid in this case. No intent to take the property, no B&E since it isn’t real property, so it’s clear cut vandalism.

Uhhhhhh not really. You hit the throttle to go, brakes to stop, and turn the wheel to change directions. If something goes wrong, the operator is almost always at fault.
