In the US it is. The property may be private, but the airspace isn’t. The FAA treats interfering with a drone or the operator just as they would for interfering with an airplane or airplane pilot.

Encryption will always be a cat and mouse game. I’m sure whatever was leaked is already obsolete just based on protocol. In my line of work, we use secure encrypted radios. If the keys are even suspected of being compromised, we update them.
