You can see it however you want about it being a loophole, but the companies (Draft Kings, Fanduel, etc.) did not write the alleged loophole in any gambling laws. The UIGEA was written in 2006, well before any Daily Fantasy sites came into existence. But it really shouldn’t matter, as it’s a game of skill, like chess…
