I agree, it would have been better to explain the problem beforehand. Nothing is gained by saying it when they did, as if it were an afterthought.

I definitely had the same thoughts about Fringe. I think this show has paid homage to Fringe before - I think an Agent Broyles was name-dropped. So the idea that there are some shared writers makes sense.
