Apparently there was a scene that got cut from the TV version where the cop said what they were arrested for, which was trespassing.
Hank Henshaw is still alive so it’s possible. Or they could just go with someone new like with Sam and Edge.
Yeah that scene didn’t make it to the TV version. But I just inferred that they were trespassing since they had to sneak past a gate to get there.
This episode here is what I mean when I say that this show doesn’t feel like an Arrowverse show. If this were any other show it would be blow out arguements across the board and half assed make ups by the end. But here everyone made reasonable points.

Honestly, it’s just Batman-Lite because when they started the show they stripped away a lot of what made Batwoman Batwoman in favor of making a rather limp girl power statement and tying so much of the show to Batman. I liked the gimmick of showing us the flashback sequences while also moving the plot forward, That was neat.

I assumed Clark scooped them all and brought them to safety before rushing for the Fortress.

I believe they just didn’t acknowledge Clark all season until that line at the end there.

To be fair, Supergirl also pretends that anything that didn’t come over from season 1 doesn’t exist.
