I don’t really see the distinction. He was an executive producer of this show (1 of 9), not the whole MCU, and he wasn’t even attached until two months after Rhodes’ appearance on The Falcon and the Winter Soldier was released.

To be fair, paying attention to continuity outside of the show he’s making isn’t really his job. That’s more of a concern for the writing team. But, it’s still not a good look...
