AFAIK, the Constitution doesn’t mention political parties at all. The founders would’ve been aware of the concept from European politics, but they didn’t see it as something which should be be built into the legal framework.

To my ears, the “go F*ck Yourself” statement that Elon made sounds a lot like a legally binding and hard to misinterpret release of any advertising contract that a company might have had with X and its CEO.
