This show seems to confuse "privilege" and "confidentiality".
The writers do not seem to think Clementine is actually a mass-murderer. She is, but they're dumb enough to white knight their own character, for some reason.

He never said it was privileged. He said it was confidential. Privilege wouldn't mean a damned thing anyway - it would prevent forced disclosure. Confidential status means Ernesto can't reveal it of his own volition.

You got hoodwinked, then. A lot of character dialogue said "KENNY IS GOING CRAZY" but he actually wasn't. It was very much a case of telling while not showing (in fact, showing the opposite).
Was Ernesto actually a lawyer? He talked about getting "extra money" for doing the Chuck runs. I don't think an associate doing grunt work would get paid extra for doing it; maybe a mailroom drone Jimmy worked with?
