you are reading it wrong, 64gb says direct ship only, meaning it will not be in stock, for any dealer. if a customer wants it it must be directly shipped to them.

What do you mean how? He didn't do anything illegal or immoral at all. He purchased the ticket expecting the flight to be overbooked. If it wasn't and they had plenty of seats for everyone who showed up he would have got on the plane and that is all.
Not necessarily, if you can determine which flights will sell out you can buy the first ticket and just make sure you offer your seat up first when they overbooked.
