Was thinking about my comment and wanted to add that while intent matters it isn’t the end all be all. A mentally unstable stalker often doesn’t think they are threatening even when they clearly are. I’m just saying intent can’t be ignored.

Depending on past experiences a person could feel threatened about something that wasn’t intended as a threat. To use an admittedly unrelated example a rape victim, for instance, would be reasonably jumpy if a big guy happened to stand too close to her in a crowd but he clearly isn’t threatening her.
