Actually there is something called ‘tender age doctrine’ that is practiced law. It’s a common law doctrine that presumes a child belongs with the mother even though there’s no reason why a father can’t take care of children as well as a mother.

Yeah, most women I know are supporting Sanders, and their thoughts on the matter are almost invariably “Yes, we do need a woman in the White House, but not that woman.” If there were a Warren ticket with Sanders as VP me and pretty much every woman I know would vote for that in a heartbeat.

So the argument that there is no institutional sexism in the court is that most custody cases don’t even go to court? She doesn’t even address the actual outcomes of custody hearings in which over 60% of the time women gain custody.

I don’t think that’s quite it. Because policy wise, I don’t see much difference between Hillary and Bernie on women’s issues. They’re essentially identical in supporting women’s right to choose, equal pay, paid leave, etc.
