I'm sorry. I should've been clearer. Marvel has the animation rights to the X-Men, as evidenced by their being the most recent production house behind Wolverine and the X-Men, while Fox retains the live action rights to both the FF and X-Franchises.

Marvel's in a tough spot with the prospect of an X-men movie right now. They have the rights to do TV, but can't do anything that alludes to the Fox franchise of films.
