The families came after them, they are now trying to recover some of the costs from the actions of the families. If someone brings a frivolous suit against you are you going to just forgive the money you’re out for fighting that?

I have to agree with this. It’s a movie premiere, not a transfer of the crown jewels. They aren’t set up for an armed attacker, and there’s no reason they should have been. While I can understand the anger and grief of the families, it wasn’t reasonable to sue.

I can understand the thinking, but if it’s a staggering amount of money, then it’s pretty unreasonable for the theater to bear the entire cost of it, isn’t it? They didn’t do anything wrong and they’re out nearly three-quarters of a million dollars.

How about saying, “Don’t bring frivolous lawsuits?” That’s a good place to start. And, as the story already said, this is a tactic to ensure that plaintiffs don’t appeal. The plaintiffs will agree not to appeal, and the request for fees and costs will be dropped.
