Well, I suspect that admitting you are or aren’t doing something related to someone’s employment specifically because of their age is probably going to get you in trouble. If they said, “We’re not picking up your option”, that’s perfectly fine. Saying “We’re not picking up your option because you’re black/gay/old” etc…
