@SgtBarry: How about not releasing a lot of games? I'd love to see a nintendo "mass effect" but they don't do those sorts of games or many games at all.

@yuri_ha: Because pirates still buy games. Plus it didn't work for the riaa or metalica and dragged their name through the mud, and I can still download metalica. Nintendo's name is very valuable, they don't want to tarnish that by suing kids and grandmas.
